NDPS Court reserves its verdict, now hearing on October 20; Arbaaz and Munmun will also remain in jail

Aryan, son of King Khan, accused in the Cruise Drugs Party case, will remain in jail for the time being. The Special NDPS Court of Mumbai reserved the verdict after hearing the matter on Thursday. The court has fixed October 20 for the next hearing of the matter. Arbaaz Merchant and Munmun Dhamicha along with Aryan will also have to remain in jail till the 20th.

During the hearing on Aryan's bail plea, Additional Solicitor General (ASG) Anil Singh said that I want to read a part of the judgment of Sauvik Chakraborty in the High Court. The logic, in that case, was that there was no seizure of drugs, but in our case, there has been a seizure.

The High Court, in its judgment, held that the accused was an important link in the investigation and that there was money laundering. The court had held that all bailable offenses under NDPS are non-bailable. The court had said that even if there was no recovery, you were in touch with drug dealers, so bail cannot be granted. The drug dealers in the present case are Achit and Shivraj, with whom the accused were in contact.

Earlier the proceedings started late due to the late arrival of ASG. He apologized for the delay as soon as he reached the court. Today is Aryan's 7th day in jail.

  • ASG Anil Singh told the court that 6 grams of drugs have been recovered from Aryan and his friend Arbaaz and he cannot say that he had any knowledge about it. Both are good friends and both were going to enjoy.
  • ASG said that I would like to place para 12 of NCB's answer before the court. Based on the facts, my submission is that Aryan Khan has not taken any drugs for the first time. Records and evidence show that he has been regularly consuming banned substances for the past few years.
  • The ASG said that such a large amount of hard drugs cannot be used for personal use. Quantity can be estimated from chat. The peddler, Qadir, and the foreign national were in touch with Achit Kumar. We are in touch with the ministry to trace the foreign national.
  • Asg has strongly opposed Aryan's bail, referencing 13 different cases. In some of these cases, there is a matter of recovery, in some without recovery, and in some of the accused who are involved in the conspiracy, there is talk of not being given bail till the investigation is done. and has taken the reference of the decisions of the Supreme Court and the High Court.
  • Asg said that our officers are working day and night against the drug. Five officers were also attacked a few days ago. Drugs are affecting the youth. I don't need to tell the court, youth are the future of our country. The future of the country depends on this generation. This is the land of Mahatma Gandhi and Buddha. The investigation is in the preliminary stage, it is not the stage of granting bail.

Earlier on Wednesday, the hearing against the NCB bail lasted for about 3 hours, but the debate could not be completed. During this, the defense argued on the sections imposed on the accused from the Panchnama of the Narcotics Control Bureau (NCB) to get Aryan bail, while the NCB opposed the bail and presented its side.

Senior advocate Amit Desai appeared for Aryan and Additional Solicitor General (ASG) Anil Singh appeared for NCB. The ASG said, “The role of one accused in this case cannot be separated from the other. The NCB has enough material to show that Aryan was in contact with some people abroad, which seems to be part of an international drug network for the illegal purchase of drugs. Some international links related to Aryan have been traced which prima facie point towards illegal drug purchases.

The ASG said that Aryan is very influential and there is a possibility of tampering with evidence or running away from the law if released on bail. Aryan and Arbaaz Merchant were caught at the International Cruise Green Mumbai, where they cannot enter without the MV Empress card. An investigation is necessary to ascertain all these aspects.

Aryan shifted to the common barrack On
Thursday, five other accused including Aryan Khan was shifted from the Quarantine Cell to the Common Cell. Arthur Road Jail Superintendent Nitin Vaychal said that Aryan is not being given home food. They have now been shifted to the common barracks as per the rules.

NCB said – Aryan has an important role in the drugs case
NCB said that Aryan and another accused had bought drugs from Arbaaz. The NCB also placed a WhatsApp chat in the court and claimed that the investigation of this chat has revealed that Aryan Khan has an important role in the drugs case. Their case cannot be treated as isolated, as all of them were part of the rave party. Aryan's lawyer argued that no drugs were found from his client.

NCB also claimed to be in contact with Aryan's paddler, the NCB told the court that drug smugglers Achit Kumar and Shivraj used to supply charas to Aryan and Arbaaz. To this Aryan's lawyer, Desai argued that NCB was repeatedly talking about drugs and cash, but nothing was found from Aryan. Neither charas nor MD or any bullets or cash was confiscated from Aryan and NCB has seized only 6 grams of charas from Arbaaz.

Desai's allegation –
Aryan's statement was forcibly taken Aryan's lawyer Amit Desai has also called Aryan's confession as a forced statement. Desai said that the NCB is saying that Aryan has confessed that he was about to take charas with Arbaaz, but the court also knows how to get things done.
